Welcome to Big Brain. By downloading, installing, or using the Big Brain mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1. About the App

Big Brain is an AI-powered study companion developed by DPC Developments, LLC. The App provides educational tools including an AI Tutor, quiz generation, flashcard creation, note-taking, lecture recording, and other study features.

2. Eligibility

The App is intended for students and learners of all ages. Users under 13 years of age should use the App under parental supervision. By using the App, you represent that you have the legal capacity to enter into these Terms or have parental/guardian consent.

3. Account

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payments

Big Brain Pro is available as an auto-renewable subscription at $4.99 per month (USD). By subscribing, you agree to the following:

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscription at any time through your device's account settings (Apple: Settings > Apple ID > Subscriptions; Android: Google Play Store > Subscriptions).
• No refunds will be provided for the unused portion of a subscription period. Refund requests should be directed to Apple or Google per their respective policies.

5. Free Tier Limitations

Free users have access to core features with the following limitations:

• 3 AI Tutor questions per day
• 3 quizzes per week
• Limited access to premium features (Homework Helper, Lecture Recording, Notes to Podcast, Document Analyzer, AI Writing Detector)

Big Brain Pro subscribers receive unlimited access to all features.

6. AI-Generated Content

The AI Tutor and other AI features provide educational assistance powered by artificial intelligence. While we strive for accuracy, AI-generated content may contain errors. The App is intended as a study aid and should not be the sole source of information for academic work. Users should verify important information independently.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the AI features to generate harmful, abusive, or inappropriate content
• Share your account credentials with others
• Attempt to circumvent subscription or usage limitations
• Use automated systems or bots to access the App

8. Intellectual Property

The App and its original content, features, and functionality are owned by DPC Developments, LLC and are protected by copyright, trademark, and other intellectual property laws. Content you create within the App (notes, flashcards, etc.) remains your property.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.

10. Limitation of Liability

To the maximum extent permitted by law, DPC Developments, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to reliance on AI-generated content for academic purposes.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
